Consideration of Old Pension Scheme Coverage for Compassionate Appointees with Applications Submitted Before 01.01.2004
अनुकंपा नियुक्ति प्राप्त कर्मचारियों को पुरानी पेंशन योजना (OPS) का लाभ प्रदान करने संबंधी प्रस्ताव
कार्मिक एवं पेंशन विभाग को एक प्रस्ताव प्राप्त हुआ है, जिसमें अनुकंपा के आधार पर नियुक्त कर्मचारियों को पुरानी पेंशन योजना (Old Pension Scheme – OPS) के अंतर्गत शामिल किए जाने पर विचार करने का अनुरोध किया गया है। प्रस्ताव में यह सुझाव दिया गया है कि ऐसे मामलों में, जहाँ नियमित विज्ञापन अथवा अधिसूचना जारी नहीं की जाती है, पात्रता निर्धारण हेतु किसी उपयुक्त तिथि को आधार माना जाए, जैसा कि पेंशन एवं पेंशनभोगी कल्याण विभाग (DOPPW) के दिनांक 03.03.2023 के कार्यालय ज्ञापन (O.M.) के मूल सिद्धांत में निहित है।
इसके अतिरिक्त, दिनांक 25.02.2025 को सचिव (पेंशन) की अध्यक्षता में आयोजित राष्ट्रीय परिषद (जेसीएम) की बैठक में कर्मचारी पक्ष द्वारा यह मांग उठाई गई कि उन कर्मचारियों को भी पुरानी पेंशन योजना का लाभ प्रदान किया जाए, जिन्होंने अनुकंपा नियुक्ति हेतु अपना आवेदन 01.01.2004 से पूर्व प्रस्तुत किया था, किन्तु उनकी नियुक्ति प्रशासनिक प्रक्रियाओं के कारण 01.01.2004 के पश्चात हुई।
बैठक में यह भी रेखांकित किया गया कि अनुकंपा नियुक्ति के मामलों में सामान्य भर्ती प्रक्रिया की भाँति कोई विज्ञापन अथवा अधिसूचना जारी नहीं की जाती। फलस्वरूप, DOPPW के दिनांक 03.03.2023 के कार्यालय ज्ञापन में निर्धारित विज्ञापन तिथि संबंधी मानदंड को अनुकंपा नियुक्ति के मामलों में सीधे लागू करना व्यावहारिक रूप से संभव नहीं है।
इस संदर्भ में यह विचारणीय है कि जिन आश्रितों ने 01.01.2004 से पूर्व अनुकंपा नियुक्ति के लिए आवेदन किया था, उनकी नियुक्ति में हुई प्रशासनिक देरी के कारण उन्हें पुरानी पेंशन योजना के लाभ से वंचित न किया जाए। अतः न्यायसंगत एवं समानता के सिद्धांतों को ध्यान में रखते हुए ऐसे मामलों के लिए आवेदन की तिथि अथवा अन्य उपयुक्त संदर्भ तिथि को आधार मानकर उन्हें पुरानी पेंशन योजना के अंतर्गत शामिल किए जाने की संभावना पर विचार किया जा सकता है।
इस विषय पर संबंधित मंत्रालयों/विभागों से परामर्श प्राप्त कर उपयुक्त निर्णय लिया जाना अपेक्षित है, जिससे अनुकंपा नियुक्ति प्राप्त कर्मचारियों के हितों का संरक्षण सुनिश्चित किया जा सके।

विषय: Consideration of crucial date for compassionate appointments for inclusion under the CCS (Pension) Rules.
The undersigned is directed to say that a proposal has been received in this Department for considering employees appointed on compassionate grounds for inclusion under the Old Pension Scheme (OPS), in accordance with the principle underlying DOPPW OM dated 03.03.2023, by fixing a date of advertisement in their case. It was also requested by the staff side during the meeting of the National Council (JCM) held on 25.02.2025 under the Chairmanship of Secretary (Pension) that the facility of coverage under OPS be extended to compassionate ground appointees who had submitted their application before 01.01.2004 but were appointed after 01.01.2004. Further, it was highlighted that there is no Notification/Advertisement in the case of appointments on compassionate grounds.
After inter‑ministerial consultation and examination in consultation with the Department of Expenditure and DoPT, it has been decided that the date of application for Compassionate Appointment shall be considered as the crucial date, provided that the applicants were eligible to be considered for appointment at the time of their application.
The family member who is eligible for being considered for appointment and have applied for compassionate appointment on or before 31.12.2003 shall be considered under CCS (Pension) Rules, 2021 by the concerned Ministries/Departments.
All Ministries/Departments are requested that the above instructions may be considered in all such cases of compassionate appointments.
This issues in consultation with Ministry of Finance, Department of Expenditure vide ID Note No.1(7)/EV/2019 dated 21.05.2026.
5. In their application to the employees of Indian Audit and Accounts Department, these orders are issued after consultation with Comptroller and Auditor General of India, as mandated under Article 148(5) of the Constitution.
