NOTIFICATION

New Delhi, the 3rd June, 2025

G.S.R. 363(E).— In exercise of the powers conferred by section 15 of the Ladakh Civil Services Decentralization and Recruitment (Amendment) Regulation, 2025, the President hereby makes the following rules, namely:-

1. Short title, extent and commencement: – (1) These rules may be called the Ladakh Civil Services Decentralization and Recruitment-Grant of Domicile Certificate (Procedure) Rules, 2025.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Definition.– (1) In these rules, unless the context otherwise requires,

a) “Competent Authority” means Tehsildar within his territorial jurisdiction, or any other officer as may be notified by the Administration from time to time in this regard for the purposes of issuance of Domicile Certificate;

b) “Domicile” means domicile as defined in section 3A of the Ladakh Civil Services Decentralization and Recruitment (Amendment) Regulation, 2025;

c) “Domicile Certificate” means a certificate issued under rule 5 for the purposes of appointment to any post under the Union territory of Ladakh;

d) “Regulation” means the Ladakh Civil Services Decentralization and Recruitment (Amendment) Regulation, 2025.

(2) Words and expressions used herein, and not defined but defined in the Regulation, shall have the same meanings as respectively assigned to them in the Regulation.

3. Application for grant of Domicile Certificate.

(1) Any person who is eligible for grant of Domicile Certificate may apply to the Competent Authority for grant of Domicile Certificate in the format to be made by the Administration of Ladakh, either physically or electronically, as may be decided by the Administration.

(2) In case of minors and persons of disability, the application for grant of certificate may be made and other acts to be performed by either of their parents or guardians, as the case may be.

(3) Every application made under sub-rules (1) and (2) shall be accompanied by such documents as are specified under these rules.

4. Class of persons, documents required, Authority Competent and Appellate Authority for issuance of Domicile Certificate.-

(1) Any person eligible for Domicile Certificate under various categories specified in column-II of the Table below, shall apply to the Competent Authority as specified in column-IV, along with documents specified in column-V against each category of the said Table, for issuance of Domicile Certificate, namely :-

3 (a) A person who has resided for a period of fifteen years in the Union territory                  of Ladakh Section 3A(1) (a) Tehsildar Any document such as Ration Card, immovable property records; educational records, voter list, electricity utility bills, or employer certificate verified by the Deputy Labour Commissioner or the Director of Industries and Commerce of the concerned Division, or, any other document of proof residence indicating period of fifteen years of residence in the Union territory Deputy Commissioner

of Ladakh from the date of formation of the Union territory of Ladakh, that is, the 31st day of October, 2019.

(b) Children of a person who has resided for a period of fifteen years in the Union territory                    of Ladakh Section 3A(2)(b) read with section 3A(1)(a) Tehsildar (a) Any document of the parent such as Ration Card, immovable property records, educational records, voter list, electricity utility bills, or employer certificate verified by the Deputy Labour Commissioner or the Director of  Industries of the Concerned Division, or, any other document of proof of residence indicating period of fifteen years of residence in the Union territory of Ladakh, from the date of formation of the Union territory  of Ladakh, that is, the 31st day of October, 2019 ,and

(b)   Birth Certificate issued by the Competent Authority.

4 A person who has studied for a period of seven years and appeared in class 10th  or 12th examination in an educational institution located in the  Union territory of Ladakh Section 3A(1)(b) Tehsildar Certificate of education issued by the Head of the Institute and verified by Chief Education Officer of the School Department of the concerned District indicating period of seven years of study in the Union territory of Ladakh from the date of formation of the Union territory of Ladakh, that is, the 31st day of October, 2019 and class 10th or 12th appearance certificate. Children of Central Government officers, Officials of Public Sector Undertakings, Autonomous Body of Central Government, Public sector Banks, Officials of Central Universities and recognized Research Institution of Central Government who shall have served the Union territory of Ladakh for a total period of ten years. Section 3A(2)(a) An officer to be nominated by the Administrator (a)          Certificate      of service issued by the Controlling Authority indicating period  of  ten  years served in the Central Government  offices or          organisations located in the Union territory   of Ladakh from   the   date   of formation      of     the Union   territory   of Ladakh, that is, the 31st  day of October, 2019 , and

(b)     Birth Certificate issued        by        the Competent Authority.

(2) The Administrator may, by notification, specify the Competent Authority for documents as specified in the Table under sub rule (1).

(3) Any person aggrieved by an order of the Competent Authority may file an appeal before the Appellate Authority as specified in column VI:

Provided that the Appellate Authority shall decide the appeal after giving an opportunity of being heard to the parties.

5. Grant of Domicile Certificate.-

(1) On the basis of documents furnished by the applicant under rule 4 and after holding such enquiry as the Competent Authority may deem necessary, the Competent Authority shall either issue Domicile Certificate in the format referred to in Rule 3, to the applicant bearing its seal and signatures or reject the application.

(2) The format shall clearly mention that the domicile certificate is valid only for the purpose of appointment to the posts under the Union territory of Ladakh as defined in Ladakh Civil Services Decentralization and Recruitment (Amendment) Regulation, 2025.

(3) The Competent Authority may also issue Domicile Certificate electronically, as may be decided by the Government.

6. Revision.- The Appellate Authority may, suo motu or on an application made to it, call for the records of the proceedings taken, or orders made, by any Competent Authority for the purposes of satisfying itself as to the legality and propriety of such proceedings or orders and may pass such orders in reference thereto as it deems fit:

Provided that no order shall be made against any person without giving him a reasonable opportunity of being heard.

7. Interpretation.– If any question of interpretation of any of the provisions of these rules arises, the same may be referred to the Administrator of the Union territory of Ladakh for decision thereon.
