Revoking Passport of NRI Husbands एनआरओआई पतियों के पासपोर्ट रद्द 

         विदेश मत्रालय ने अपनी पत्नियों का परित्याग करने वाल अनिवासी भारतीय (एनआरआई) पतियों के पासपोर्ट लुकआउट सर्कुलरों/गैर-जमानती वारंटों/समनों/न्यायालय नोटिसों के आधार पर पासपोर्ट अधिनियम, 1967 की धारा 10 ए के अंतर्गत निलंबित और पासपोर्ट अधिनियम, 1967 की धारा 10 (3) के अंतर्गत पासपोर्ट जब्त/निरस्त किए हैं। विदेश मंत्रालय ने 21 पासपोर्ट निरस्त 21 पासपोर्ट निलंबित और 1 पासपोर्ट जब्त किए हैं।

         अपने अनिवासी भारतीय पतियों द्वारा परित्यक्त या प्रताड़ित भारतीय महिलाओं की ओर से विदेश मंत्रालय को अर्जियां प्राप्त होती रही हैं। इस मंत्रालय (विदेश स्थित भारतीय मिशनों सहित) ने जनवरी, 2016 से दिसंबर, 2018 के बीच अपने अनिवासी भारतीय पतियों द्वारा परित्यक्त पीड़ित भारतीय महिलाओं की 5,379 शिकायतों का निपटान किया है। निपटान की गई शिकायतों के वर्ष-वार आकड़े निम्नानुसार हैं:

         इस मंत्रालय (विदेश स्थित भारतीय मिशन सहित) ने अनिवासी भारतीय पतियों द्वारा परित्यक्त  पीड़ित भारतीय महिलाओं की शिकायतों का निपटान करने के लिए प्रवासी भारतीय पति को न्यायिक समन भेजने, भारत में मुकदमा दर्ज कराने, लुक आउट सर्कुलर जारी कराने, पति के पासपोर्ट को जब्त और रद्द करवाने, भारतीय मिशनों के साथ सूचीबद्ध वकीलों और गैर-सरकारी संगठनों से संपर्क स्थापित करने आदि की प्रक्रियाओं, तंत्रों के बारे में परामर्श, मार्गदर्शन और सूचना प्रदान की है। इसके अतिरिक्त, अनिवासी भारतीय पतियों से विवाहित तथा पीड़ित महिलाओं को सभी मिशनों और केंद्रों के माध्यम से वित्तीय और कानूनी सहायता प्रदान किए जाने के उद्देश्य से भारतीय समुदाय कल्याण कोष (आईसीडब्ल्यूएफ) के दिशा-निर्देश में सितंबर, 2017 में संशोधन किए गए थे। पीड़ित भारतीय महिलाओं के लिए कानूनी एवं वित्तीय सहायता की राशि को भी बढ़ाकर प्रति मामला 4000 अमरीकी डालर कर दिया गया है। यह सहायता आवेदक के सूचीबद्ध कानूनी सलाहकार या संबंधित भारतीय समुदाय एसोसिएशन/महिला संगठन/गैर-सरकारी संगठन को जारी की जाती है ताकि मुकदमा दर्ज कराने हेतु प्रलेखीकरण और प्रारंभिक कार्य में महिला की सहायता करने हेतु कदम उठाने में उसे सक्षम बनाया जा सके।

        प्रवासी भारतीय नागरिकों से विवाहित भारतीय नागरिकों की कानूनी और विनियामक चुनौतियों की पहचान करने और मौजूदा अधिनियमों/विधानों या नई नीतियों/कानूनों/विनियमों में संशोधन करने का सुझाव देने के लिए एक विशेषज्ञ समिति का गठन किया गया था। विशेषज्ञ समिति की कुछ सिफारिशों को स्वीकार कर लिया गया है जिसमें एक एकीकृत नोडल एजेंसी का गठन भी शामिल है।

         सचिव, महिला एवं बाल विकास एकीकृत नोडल एजेंसी के अध्यक्ष हैं। एकीकृत नोडल एजेंसी के अन्य सदस्य हैं

  • क) संयुक्त सचिव (न्यायिक) एवं संयुक्त सचिव (विदेशी नागरिक), गृह मंत्रालय, 
  • ख) संयुक्तसचिव (ओआईए-॥), विदेश मंत्रालय और 
  • ग) संयुक्त सचिव (विधि), विधि एवं न्याय मंत्रालय। 

        एकीकृत नोडल एजेंसी एक प्रभावी निकाय के रूप में कार्य कर रही है और प्रवासी भारतीय पतियों से विवाहित भारतीय महिलाओं की समस्याओं का समय पर सिंगल विंडो समाधान प्रदान कर रही है। अब तक, एकीकृत नोडल एजेंसी की तेरह बैठकें की जा चुकी हैं और इसके द्वारा गलती करने वाले पतियों के विरूद्ध आठ

लुकआउट सर्कुलर जारी किए जा चुके हैं।

  • (क) क्या सरकार ने अपनी पत्नियों को छोड़ने वाले कुछ अनिवासी भारतीयों (एनआरआई) के पासपोर्ट रद्द किए हैं;
  • (ख) यदि हां, तो तत्संबंधी ब्यौरा क्या है;
  • (ग) विगत तीन वर्षों के दौरान अपनी पत्नियों को छोड़ने संबंधी शिकायतों की वर्ष-वार और राज्य/संघ राज्य क्षेत्र-वार संख्या कितनी है; और
  • (घ) पतियों द्वारा पत्नियों को छोड़ने की घटनाओं को कम करने हेतु सरकार द्वारा उठाए गए या प्रस्तावित कदम कया हैं?

REVOKING PASSPORT OF NRI HUSBANDS 

     The Ministry of External Affairs has, on the basis of Look Out Circulars/Non- Bailable Warrants/Summons/Court Notices, suspended passports under Section 10A of the Passports Act, 1967 and impounded/revoked under Section 10(3) of the Passports Act, 1967, of Non Resident Indians (NRI) husbands for deserting their wives. The Ministry of External Affairs has revoked 21 passports, suspended 21 passports and impounded 1 passport.

           This Ministry does not maintain State-wise data. However, it has been receiving petitions from Indian women who have been deserted or harassed by their NRI spouses. Between January 2014 and December 2018 this Ministry (including the Indian Missions abroad) has addressed 5379 complaints of distressed Indian women deserted by their NRI spouses.       This Ministry (including the Indian Missions abroad) has addressed these complaints of distressed Indian women deserted by their NRI spouses by way of providing them counseling, guidance and information about procedures, mechanisms for serving judicial summons on the Overseas Indian husband, filing a case in India, issuing Look Out Circulars, impounding and revocation of Indian passport of the husband, getting access to lawyers and NGOs empanelled with Indian Missions etc.
         In addition, with an aim to provide financial and legal assistance to distressed women married to NRI spouses by all Missions and Posts, the Indian Community Welfare Fund (ICWF) Guidelines were revised in September, 2017. The amount of legal & financial assistance to distressed Indian women has also been increased to US$ 4000 per case. The assistance is released to the empanelled legal counsel of the applicant or Indian Community Association/Women’s Organization /NGO concerned to enable it to take steps to assist the woman in documentation and preparatory work for filing the case.
       An Expert Committee was set up to identify legal and regulatory challenges faced by Indian nationals married to overseas Indian nationals and to suggest amendments in existing Acts/legislations or new policies/laws/regulations. Some of the recommendations of the Expert Committee have been accepted including the constitution of an Integrated Nodal Agency.
        The INA is headed by Secretary, Women & Child Development. The other members of the INA are 
  • a) Joint Secretary (Judicial) & Joint Secretary (Foreigners), Ministry of Home Affairs, 
  • b) Joint Secretary (OIA-II), Ministry of External Affairs, and
  • c) Joint Secretary (Legal), Ministry of Law & Justice. 

        The INA is functioning as an effective body and providing a single window timely solution to the problems of Indian women married to overseas Indian spouses. So far, the INA has had thirteen sittings and has issued eight Look Out Circulars against the erring spouses.
