EMPLOYEES’ STATE INSURANCE CORPORATION

New Delhi, the 27th March, 2024
No. A-12(11)5/2024-Estt. I.(4).―In exercise of the powers conferred by sub-section (1) and clause (xxi) of sub-section (2) of section 97 read with sub-section (2A) of that section and clause (a) of sub-section (2) of section 17 of the Employees’ State Insurance Act, 1948 (34 of 1948), and in supersession of the Employees’ State Insurance Corporation (Insurance Commissioner) Recruitment Regulations, 2013 except as respects of things done or omitted to be done before such supersession, the Employees’ State Insurance Corporation, hereby makes, with the approval of the Central Government, the following regulations, regulating the method of recruitment to the post of Insurance Commissioner in the Employees’ State Insurance Corporation, namely:-

1. Short title and commencement.―

(1) These regulations may be called the Employees’ State Insurance Corporation (Insurance Commissioner) Recruitment Regulations, 2024.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in pay matrix.―The number of the posts, their classification and level in the pay matrix attached to the said post shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.
3. Method of recruitment, age-limit, qualifications, etc.―The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.―No person, ―
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Chairman of the Employees’ State Insurance Corporation may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation.
5. Power to relax.―Where the Director General of the Employees’ State Insurance Corporation is of the opinion that it is necessary or expedient so to do, he may with the approval of Chairman of the Employees’ State Insurance Corporation after taking prior approval of the Central Government, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these regulations, with respect to any class or category of persons.
6. Savings.―Nothing in these regulations shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

By promotion: Additional Commissioner in Level 13A in the pay matrix (Rs. 1,31,100 -2,16,600) with two years regular service in the grade and having successfully completed mandatory training program for promotion to the post of Insurance Commissioner as conducted by the Employees State Insurance Corporation from time to time.

Note 1: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

By deputation (Including short-term contract): Officers of Central Government or State Governments or Union territory Administrations or public sector undertakings or statutory or autonomous bodies or recognised Universities/institutes/research institutions:

(a) (i) holding analogous post on regular basis in the parent cadre or Department; or

(ii) with two years regular service in post in level 13 A in the pay matrix (Rs. 1,31,100 -2,16,600) or equivalent in the parent cadre or Department or

(iii) with three year’s regular service in post in level 13 in the pay matrix (Rs. 1,23,100-2,15,900) or equivalent in the parent cadre or Department and

(b)   possessing the following educational qualifications and experience:

(i)   Bachelors Degree from a recognised University/institute; and

(ii)  fifteen years experience in financial or administrative matters or dealing with social security scheme or labour law.

Note 1: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation/ Department of the Central Government shall ordinarily not exceed five years. The Maximum age-limit for appointment by deputation shall be not exceeding 58 years as on the last date of receipt of application.

Note 2: The Departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.
