REVERSION TO OLD PENSION SCHEME

Will the PRIME MINISTER be pleased to state:
(a) whether the Supreme Court has dismissed more than half dozen Special Leave Petitions (SLPs) including SLP Nos.15312-15321/2021 and Review Petitions and ordered that Central Government officials whose advertisements were issued before 01101/2004 and joining and results occurred after 31.12.2003 be reverted back to old pension scheme;
(b) if so, the status of implementation of all such judgements along with the number of employees who have been granted relief therein;
(c) the details of the comments received from the Department of Financial Services and Department of Legal Affairs and the action being taken by the Government for issuing general/executive orders in light of comments received to cover similarly placed employees; and
(d) if not, whether this has led to long litigation process for affected Government employees in the matter which has attained finality and also implemented in some of the judgements and if so, the comments thereof?

(a) & (b): Hon’ble Supreme Court has dismissed some of SLPs I Review Petitions filed by Union of India against the orders of Hon’ble High Court of Delhi allowing benefit of old pension scheme to those Government servants whose selection process was completed after 01.01.2004. Details of cases is enclosed at Annexure-A.
(c): Department of Financial Services in their comments have conveyed that DoPPW my take appropriate decision in regard to excluding the employees whose recruitment. advertisement was issued on or before 01.01.2004 from the purview of NPS and cover them under OPS.
Department of Legal Affairs has conveyed that the examination of the issue in this Department to the effect that an administrative decision to issue executive instructions providing for coverage of Government servants under old pension scheme who were appointed to Central Government service on or after 01.01.2004 on the basis of advertisement/notification of vacancies issued prior to 01.01.2004 appears to be in order.
There is no decision to issue general instructions in this regard.
(d): National Pension System (NPS) was introduced for Central Government employees by a Notification of Minist.ry of Finance (Department of Economic Affairs) dated 22nd December, 2003. NPS is mandatory for all new recruits to the Central Government service from 1st January, 2004 (except the armed forces).
In view of the specific provisions of the Notification dated 22.12.2003, the date of advertisement for the vacancies is not considered relevant for determining the eligibility for coverage under the Old Pension Scheme or the National Pension System.

क्याप्रधानमंत्री यह बताने की कृपा करेंगे कि; द
(क) क्या उच्चतम न्यायालय ने एसएलपी संख्या 15312-15321/2021 सहित आधा दर्जन से अधिक विशेष अनुमति याचिका और समीक्षा याचिकाओं को खरिज कर दिया है और आदेश दिया है कि केंद्र सरकार के वे कर्मचारी जिनके पद विज्ञापन 01/01/2004 से पहले जारी किए गए थे और जिनकी ज्वाइनिंग व परिणाम 31.12.2003 के बाद घोषित हुआ था, उन्हें पुरानी पेंशन योजना में शामिल किया जाए;
(ख) यदि हां, तो ऐसे सभी निर्णयों के कार्यान्वयन की स्थिति क्या है और इन निर्णयों से कितने रा कर्मचारियों को राहत प्रदान की गई है;
(ग) इस संबंध में वित्तीय सेवा विभाग और विधि विभाग से प्राप्त टिप्पणियों का ब्यौरा कया है और सरकार द्वारा समतुल्य रूप से पदस्थापित कर्मचारियों को इसमें शामिल करने के लिए प्राप्त टिप्पणियों के आलोक में, इस हेतु सामान्य/कार्यकारी आदेश जारी करने के लिए की जा रही कार्रवाई का ब्यौरा कया है; और ..
(घ) यदि नहीं, तो क्या जिन मामलों का अंतिम निर्णय हो चुका था उनमें भी प्रभावित सरकारी कर्मचारियों को इस मामले में लंबी मुकदमेबाजी की प्रक्रिया से गुजरना पड़ा है और कुछ निर्णयों में इसे लागू भी किया जा चुका है और यदि हां, तो इस संबंध में कया टिप्पणियां की गई हैं?

(क) और (ख): माननीय उच्चतम न्यायात्रय ने, उन सरकारी कर्मचारियों को, जिनकी चयन प्रक्रिया 01.01.2004 के बाद पूरी हुई थी, पुरानी पेंशन योजना का लाभ देने की अनुमति देने वाले माननीय दिल्ली उच्च न्यायालय के आदेशों के विरुद्ध केंद्र सरकार द्वारा दायर कुछ एसएलपी/समीक्षा याचिकाओं को खारिज कर दिया है। मामलों केब्यौरे अनुबंध-क में संलग्न है।
(ग): वित्तीय सेवा विभाग ने अपनी टिप्पणियों में सूचित किया है कि पेंशन और पेंशनभोगी कल्याण विभाग उन कर्मचारियों, जिनकी भर्ती के लिए विज्ञापन दिनांक 01.01.2004 को याउससे पहले जारी किया गया था, को एनपीएस के दायरे से बाहर करने और उन्हें ओपीएस के तहत कवर करने के संबंध में समुचित निर्णय ले सकता है।
विधि विभाग ने सूचित किया है किदिनांक 01.01.2004 से पूर्व जारी किए गए रिक्ति संबंधी विज्ञापन /अधिसूचना के आधारपर दिनांक 01.01.2004 को या उसके बाद केंद्र सरकार की सेवा में नियुक्त किये गये सरकारी सेवकों को पुरानी पेंशन योजना के अंतर्गत कवर करने के लिए कार्यकारी निर्देश जारी करने के प्रशासनिक निर्णय सेसंबंधित मुद्दे की इस विभाग में जांच की गई तथा उसे सही पाया गया है। इस संबंध में सामान्य आदेश जारी करने का कोई निर्णय नहीं लिया गया है।
(घ): वित्त मंत्रालय (आर्थिक कार्य विभाग) की दिनांक 22 दिसंबर, 2003की अधिसूचना द्वारा राष्ट्रीय पेंशन प्रणाली(एनपीएस) को लागू किया गया था। दिनांक 01 जनवरी, 2004 से केंद्रीय सरकार की सेवा में हुई सभी नई भर्तियों (सशस्त्र बलों को छोड़कर) के लिए राष्ट्रीय पेंशन प्रणाली (एनपीएस ) अनिवार्य है।
दिनांक 22.12.2003 की अधिसूचना के विशिष्ट उपबंधों को ध्यान में रखते हुए, पुरानी पेंशन योजना या राष्ट्रीय पेंशन प्रणाली के तहत कवर किए जाने के लिएपपात्रता निर्धारित करने के लिए रिक्तियों के लिए विज्ञापन की तारीख को प्रासंगिक नहीं माना जाता है।

Status of Implementation of judgements after dismissal of SLPs I Review Petitions:
