UNRESERVED POST TO RESERVED CATEGORY
Will the PRIME MINISTER be pleased to state:
(a) whether the Government has taken/proposed to take any steps for providing job to a reserved category person against unreserved posts in Government/Public Sector Undertakings (PSUs) in case if a candidate scores equal or higher marks as compared to a general category candidate;
(b) if so, the details thereof; and
(c) if not, the reasons therefor?

(a) to (c): In pursuance of the judgement dated 10.2.1995 of the Hon’ble Supreme Court in the Writ Petition (Civil) No. 79/1979 titled ‘R. K. Sabharwal and Ors vs State of Punjab and Ors’, persons belonging to reserved category, who are appointed on merit and not owing to reservation, occupy the unreserved points in the reservation roster.
