Railway Protection Force and Railway Protection Special Force (Amendment) Rules, 2021

NOTIFICATION

New Delhi, the 15th July, 2021

G.S.R. 500(E).—In exercise of the powers conferred by section 21 of the Railway Protection Force Act 1957 (23 of 1957), the Central Government hereby makes the following rules further to amend the Railway Protection Force Rules, 1987, namely:-

1. (1) These rules may be called the Railway Protection Force (Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Railway Protection Force Rules, 1987, (hereinafter referred to as the said rules) in sub-rule (1) of rule 27,in clause (e), for the words “Inspectors”, the words “Sub-Inspectors (Executive) of Railway Protection Force, Sub-Inspectors (Executive) of Railway Protection Special Force, Inspectors (Executive) of Railway Protection Force and Railway Protection Special Force” shall be substituted.

3. For the rule 64 of the said rules, the following rule shall be substituted, namely:-

“64. Orientation Courses:

Enrolled members of the Force after being promoted to the rank of Head Constable, Assistant Sub- Inspector or Sub-Inspector shall undergo a special course (hereinafter referred to as orientation course) at the earliest after approval of the panel at any training institution of the Force for a duration which may be fixed by the Director-General.”.

4. In sub-rule (6) of rule 70 of the said rules, in item  (iv),  for  the  words  “Three  Principal  Chief Security Commissioners or Chief Security Commissioners”, the words “three officers of the rank of Inspector General or Deputy Inspector General” shall be substituted.

5. In rule 70 of the said rules, after the sub-rule (8), the following sub-rules shall be inserted, namely:-

“70.9 The date of eligibility for residency period to be considered for promotion to the rank of Inspector shall be counted from the date of approval of the panel in case of promotees and from the date of enlistment in case of direct recruits.

70.10  The common seniority list in the rank of Sub-Inspectors and Inspectors shall be maintained at the Board’s level and the sanctioned strength, vacancy position and rosters shall be maintained at the zonal level in accordance with the procedure laid down by the directives issued under rule 28:

Provided that until the Sub-Inspectors from the common seniority list become eligible for appearing in the selection to the rank of Inspector, the selection shall be conducted based on seniority list of Sub-Inspectors maintained at the zonal level.”.

6. In rule 72 of the said rules, in sub-rule (1), for the words “Head Constable and Assistant Sub- Inspector”, the words “Head Constable, Assistant Sub-Inspector and Sub-Inspector”  shall  be substituted.

7. In rule 89 of the said rules,-

(a) In sub- rule (1),-

(i) for the words “direct recruits”, the words “direct recruits recruited for the zonal railways” shall be substituted;

(ii) the words “and Railway Protection Special Force” shall be omitted;

(b) after sub-rule (1), the following sub-rule shall be inserted, namely:-

“89.1A The direct recruits recruited for the Railway Protection Special Force shall be distributed amongst the units of the Railway Protection Special Force in such manner as may be considered necessary by the appointing authority in public interest.”.

8. In rule 89 of the said rules, for the sub-rule (2), the following sub-rule shall be substituted, namely:-

“89.2  Constables:

On successful completion of initial training, direct recruits recruited for the zonal railways shall be distributed for enrolment amongst the divisions and production units and direct recruits recruited for the Railway Protection Special Force shall be distributed among various units of the Railway Protection Special Force in such manner as may be considered necessary by the Principal Chief Security Commissioner concerned in public interest.”.

9. In rule 94 of the said rules, in sub-rule (1),-

(i) for the words “incumbents of posts in a rank”, the words “incumbents of posts in a rank joining on the basis of different selection or recruitment tests” shall be substituted.;

(ii) the following provisos shall be inserted, namely:-

“Provided that the inter se seniority among the incumbents of post in a rank, selected through a common recruitment test, but sent for initial training in different training centres due to administrative reasons and not because of reasons attributable to the candidates, shall be determined on the basis of merit list prepared after giving 90% weightage to the marks obtained in the recruitment test and 10% weightage to marks obtained in the examination conducted at the end of initial training, if the incumbents pass the examination at the end of initial training in the first attempt and those incumbents who pass the examination in the subsequent attempts in the same initial training shall rank junior to those who passed in the first attempt:

Provided further that the marks awarded by different training centres shall be adjusted by using standard statistical methods to equalise evaluation among various training centres:

Provided also that the incumbents of posts in a rank selected through a common recruitment test but joining initial training late because of reasons attributable to the candidates shall rank junior to those who joined training as per the directions of the administration.”.

10. In rule 96 of the said rules, for clause (i), the following clauses shall be substituted, namely:-

“(i) candidates who are recruited through the common examination and sent for initial training in different batches shall rank in seniority in relevant grade in the order of merit obtained after giving 90% weightage to the marks obtained in recruitment test and 10% weightage to marks obtained in examination conducted at the end of initial training and those who pass the exam held at the end of training period in the second attempt shall rank junior to those who passed in the first attempt.

(i,a)   The marks awarded in different batches shall be adjusted by using standard statistical methods to equalise evaluation among various batches.”.

11. In rule 97 of the said rules, the following rule shall be substituted, namely:-

“97   Seniority of departmental promotees:

The seniority of promotees shall be determined according to the position assigned to them in the select panel by the Departmental Promotion Committee and notional seniority shall be based on the date of approval of the panel.”.

12. In rule 98 of the said rules,-

(a) in sub-rule (1),-

(i) for the words “the date of promotion in the case of promotees”, the words “the date of issue of panel in case of promotees” shall be substituted;

(ii) the words “This rule shall apply to recruitments both in initial and intermediate grades” shall be omitted;

(b) after sub-rule (1), the following sub-rule shall be inserted, namely:-

“98.1A The inter se seniority of direct recruits from the same common entrance examination but trained in different batches in different training institutes and promotes shall be decided as per the directives issued under rule 28.”.

13. In rule 99 of the said rules,-

(a) in sub-rule (1),the words “or to the Railway Protection Special Force and vice versa” and “or Railway Protection Special Force”shall be omitted;

(b) in sub-rule (2),-

(i) for the words “enrolled member of the force”, the words “enrolled member (except Sub- Inspectors or Inspectors) of the force” shall be substituted;

(ii) the words “ to the Railway Protection Special Force and vice versa” and “or Railway Protection Special Force” shall be omitted;

(c) after sub-rule (2), the following sub rule shall be inserted, namely:-

“99.2A There shall be no change in the Seniority of Sub-Inspectors or Inspectors transferred on mutual exchange or on own request from one zonal railway to another zonal railway as these ranks fall under centralised seniority.”.

14. In Schedule I to the said rules,-

(i) for S. No.27, 28, 29, 30 and 31 and entries relating thereto, the following serial numbers and entries shall be substituted, namely:-
