NOTIFICATION

New Delhi, the 4th May, 2021

G.S.R. 336(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways G.S.R 56(E), dated the 29th January, 2021, in the Gazette of India, Extraordinary, Part II, section (3), sub-section (i) inviting objections and suggestions from all persons likely to be affected before the expiry of the period of thirty days from the date on which copies of the official Gazette containing the said notification were made available to the public;

Whereas, copies of the said official Gazette in which the said notification were made available to the public on the 29th January, 2021;

And, whereas, no objections and suggestions were received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, (59 of 1988),

the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: —

1. Short title and commencement. – 

(1) These rules may be called as the Central Motor Vehicles (Eighth Amendment) Rules, 2021.

(2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), after rule 115-AA, the following rule shall be inserted, namely:-

“115AB.  Mass  emission  standards  for  CNG,  Bio-CNG,  LNG  driven  agriculture  tractors,  power  tillers, construction equipment vehicles and combine harvesters.-

(I) For conversion by modification of engines of In-use Diesel Vehicle

(a) In case of agriculture tractors,  power tillers, construction equipment vehicles and  combine harvesters, Type approval for diesel engine retrofitted for dedicated CNG/ Bio-CNG/LNG operation shall be given for specific make and model of the vehicle, and shall be approved as per the prevailing mass emission standards applicable for diesel engines of agriculture tractors, power tillers, construction equipment vehicles and combine  harvesters, with the  exception that  the HC (Hydrocarbon)  shall  be replaced by NMHC (Non-Methane Hydrocarbon) on measurement basis, as detailed in rule 115 AA;

(b) Test for particulate matter and emission of visible pollutants (smoke) under these rules shall not applicable;

(c) CNG/Bio-CNG/LNG kit approved on the vehicle for specific engine capacity can be installed on specific make and model of vehicle and its variants fitted with the same capacity engine;

(d) The CNG/Bio-CNG/LNG composition used for carrying out emissions shall meet the fuel specifications as notified by the Central Government from time to time;

(e) Separate type approval is required for mechanically controlled and electronically controlled diesel Fuel injected vehicles when retrofitted for CNG /Bio-CNG/LNG operation;

(f) For retrofitment on “in-use” vehicles, the responsibility of the Type Approval and COP shall be that of the kit manufacturer or supplier. Prevailing COP procedure will also be applicable;

(g) The type approval certificate of CNG or Bio-CNG or LNG for replacement engine shall be valid for three years from the date of the issue of type approval certificate and shall be renewable for three years at a time;

(h) For the purpose of granting type approval to the agriculture tractor, power tiller, construction equipment vehicle/combine harvester fitted with CNG/Bio-CNG/LNG engine (converted from Diesel engine) as O.E. or retrofitment of ‘In-use diesel vehicle’, following performance Tests shall be carried out as per the table given below by the test agencies, namely:-

(ii) Engine performance test (gross power -without fan)

Note: 
  • (a) The mass emission test shall be carried out on engine dynamometer, as applicable.
  • (b) Vehicles offered for type approval to the testing agency referred in rule 126 of Central Motor Vehicles Rules, 1989 shall have to comply with fitness requirement as applicable under these rules;
  • (c) Test procedure and safety guidelines of CNG/Bio-CNG/LNG vehicles, kit components including installation thereof, shall be as per Annexure IX AIS 024 and AIS 028(rev.1), as amended from time to time;
  • (d) The test agency shall complete the test and give necessary certificate within three months of the same being submitted for test;
  • (e) Testing agencies will be required to indicate specifically, the models and their variants on which the replacement of new engine will be valid.
(II) Replacement of In-use Diesel Engine by New dedicated CNG/ Bio-CNG/LNG Engine-
(a) In case of agriculture tractors, power tillers, construction equipment vehicles and combine harvesters having in- use diesel engine which is replaced with a Compressed Natural Gas (hereinafter referred to as CNG) or Bio- Compressed natural gas ((hereinafter referred to as Bio-CNG) or LNG (Liquefied Natural Gas), Type approval shall be given for specific make and model of vehicle and shall be approved as per prevailing mass emission norms. Emission test procedure shall be as per MoRTH/CMVR/TAP-115/116 (as amended from time to time) and as notified by the Central Government from time to time under the applicable law. Mass emission standards for CNG or Bio- CNG or LNG engines of agriculture tractors, power tillers, construction equipment vehicles and combine harvesters shall be same as the prevailing mass emission standards applicable for diesel engines of agriculture tractors, power tillers, construction equipment vehicles and combine harvesters, with the exception that the HC (Hydrocarbon) shall be replaced by NMHC (Non-Methane Hydrocarbon) on measurement basis as detailed in rule 115 AA;
(b) CNG or Bio-CNG or LNG replacement engine approved on the vehicle for specific engine capacity can be installed on the specific make and model of vehicle and its variants fitted with the same capacity engine;
(c) Test procedure and safety guidelines for such CNG, Bio-CNG, LNG kit components, including installation thereof, shall be as per AIS 024 and AIS 028 Rev 01 as applicable and amended from time to time, till such time as corresponding BIS specifications are notified;
(d) The CNG/Bio-CNG/LNG composition used for carrying out emissions shall meet the fuel specifications as notified by the Central Government from time to time,
(e) Tests for particulate matter and emission of visible pollutants (smoke) stipulated in the rule 115AA shall not be applicable for CNG or Bio-CNG or LNG engine or vehicle;
(f) For OE replacement engine and aftermarket replacement engine on “in-use” vehicles, the responsibility of the Type Approval and COP shall be that of the vehicle manufacturer and replacement engine manufacturer or supplier respectively. Prevailing COP procedure will also be applicable;
(g) The type approval certificate of CNG or Bio-CNG or LNG for replacement engine shall be valid for three years from  the  date  of  the  issue  of  type  approval  certificate  and  shall  be  renewable  for  3  years  at  a  time;
(h) For the purpose of granting type approval to the agriculture tractor, power tiller, construction equipment vehicle / combine harvester fitted with replacement CNG/Bio-CNG/LNG engine, following performance Tests shall be carried out as per the table given below by the test agencies, namely:-

Explanation:-
  • a. The mass emission test shall be carried out on engine dynamometer, as applicable.
  • b. Vehicles offered for type approval to the testing agency referred in rule 126 shall have to comply with fitness requirement, as applicable under these rules.
  • c. Test procedure and  safety guidelines for such  CNG/Bio-CNG/LNG vehicles, kit component including installation thereof shall be as per AIS 024, AIS 028 (rev.1) as amended from time to time, till such time as corresponding BIS specification are notified.
