EARTHQUAKE RESISTANT BUILDINGS UNDER HOUSING FOR ALL
‘सबके लिए आवास? के अन्तर्गत भूकम्प-रोधी भवन

Will the Minister of HOUSING AND URBAN AFFAIRS be pleased to state:
(a) whether Government has any plan to construct earth quake resistant buildings under its ‘Housing for All’ scheme and if so, the details thereof;
(b) whether Government has prescribed any guidelines or standards for earthquake resistant constructions for private use real estate projects; and
(c) if so, the details thereof and if not, the details of an alternate competent authority in this regard?
ANSWER

(a) The Scheme Guidelines of Pradhan Mantri Awas Yojana (Urban) [PMAY(U)] provides that the houses under the mission should be designed and constructed to meet the requirements of structural safety against earthquake, flood, cyclone, landslides etc. conforming to the National Building Code and other relevant Bureau of Indian Standards (BIS) codes.

(b) & (c) The Building Bye-laws of respective State/ UT Government / Urban Local Body/Development Authority etc. has to be mandatorily followed/conformed for all kind of building construction & infrastructure development works including private use real estate projects.
Ministry of Housing and Urban Affairs has issued “Model Building Bye-Laws-2016” for the guidance of the State/UT Governments, Urban Local Bodies, Urban Development Authorities, etc. This Model Building Bye-Law lays focus on structural safety of buildings to protect buildings against fire, earthquake, noise, structural failures and other hazards. Building Bye-Laws are legal tools used to regulate coverage, height, building bulk and architectural design and construction aspects of buildings so as to achieve orderly development of an area.
Further, National Disaster Management Authority has issued “National Disaster Management Guidelines on Ensuring Disaster Resilient Construction of Buildings and Infrastructure financed through Banks and Other Lending Institutions” in September 2010. This is for ensuring disaster resilience by the Techno-Financial Regime of Banks and other Lending Institutions.

(क) कया सरकार की अपनी ‘सबके लिए आवास योजना के अन्तर्गत भूकम्प-रोधी भवनों का निर्माण करने की कोई योजना है और यदि हां, तो तत्संबंधी ब्यौरा कया है;
(ख) क्या सरकार ने निजी उपयोग वाली रियल एस्टेट परियोजनाओं के लिए भूकम्प-रोधी निर्माण के लिए कोई दिशानिर्देश या मानक निर्धरित किए हैं; और
(ग) यदि हां, तो तत्संबंधी ब्यौरा क्या है और यदि नहीं, तो इस संबंध में मौजूद किसी वैकल्पिक सक्षम प्राधिकरण का ब्यौरा क्या है?

(क) प्रधानमंत्री आवास योजना (शहरी) (पीएमएवाई(यू)) के स्कीम दिशानिर्देशों में यह व्यवस्था की गई है कि इस मिशन के अंतरगत आवासों को इस तरह से डिजाइन और निर्मित किया जाए कि वे भूंकप, बाढ़, समुद्री तूफान, भू-स्खलन इत्यादि के विरूद्ध अवसंरचनात्मक सुरक्षा की अपेक्षाओं को पूरा करें और राष्ट्रीय भवन निर्माण कोड और ब्यूरो ऑफ इंडियन स्टैंडर्ड (बीआईएस) के अन्य संगत कोड के अनुरूप हों।

(ख) ओर (ग) संबंधित राज्य/यूटी सरकार/शहरी स्थानीय निकाय/विकास प्राधिकरण इत्यादि के भवन निर्माण उप-नियमों का निजी उपयोग रियल एस्टेट परियोजनाओं सहित सभी प्रकार के भवन निर्माण एवं अवसंरचना विकास कार्यों के लिए अनिवार्य रूप से पालन किया जाए/उनके अनुरूप होना चाहिए। आवासन और शहरी कार्य मंत्रालय ने राज्य/संघ शासित क्षेत्र सरकारों, शहरी स्थानीय निकायों, शहरी विकास प्राधिकरणों इत्यादि के मार्गदर्शन हेतु “आदर्श भवन निर्माण उप-नियम 2016” जारी किए है। यह भवन निर्माण उप-नियम भवन को अग्नि भृंकप, शोर, संरचनात्मक असफलता और अन्य जोखिमों से भवन को बचाने के लिए भवन की ढांचागत सुरक्षा पर प्रकाश डालते हैं।
भवन निर्माण उप-नियम विधिक औजार हैं जिनका इस्तेमात्र एक क्षेत्र के सुव्यवस्थित विकास के लिए कवरेज, ऊंचाई, बिल्डिंग आकार और वास्तुशिल्पीय डिजाइन तथा भवनों के निर्माण पहलुओं को विनियमित करने के लिए किया जाता है।
इसके अलावा, राष्ट्रीय आपदा प्रबंधन प्राधिकरण ने सितंबर, 2010 में बैकों और अन्य ऋणदाता संस्थाओं के माध्यम से भवनों और अवसंरचना के आपदा विरोधी निर्माण को सुनिश्चित करने के लिए “राष्ट्रीय आपदा प्रबंधन दिशानिर्देश” जारी किए हैं। यह टेक्नो-फाइनेंसल रिजिम ऑफ बैक तथा अन्य ऋणदाता संस्थाओं द्वारा आपदा से निपटने को सुनिश्चित करने के लिए है।
